These terms apply when you use milkbarmilkbar.com or purchase from Milk Bar. By using the store or placing an order, you agree to these terms. References to “we”, “us” and “our” mean Milk Bar.

STORE INFORMATION AND ELIGIBILITY

You must provide current and accurate information when placing an order. You must be legally capable of entering into the purchase or have permission from a parent or guardian.

PRODUCTS, PRICING AND AVAILABILITY

We aim to describe and display our products accurately. Screen settings and the print-on-demand process can cause minor differences in colour or print placement.

These statements do not limit your rights concerning products that are materially different from their description or otherwise fail a consumer guarantee.

Prices are shown in the currency indicated on the store. Australian standard shipping is included only where expressly stated. International shipping, duties and taxes may be additional.

We may change prices or product availability prospectively without notice.

ORDERS

An order is an offer to purchase. We may accept, decline or cancel an order where reasonably necessary, including in cases of suspected fraud, pricing or stock errors, fulfilment limitations, or a breach of these terms.

If we cancel a paid order, we will refund the amount paid for the cancelled item or order.

Items are made to order through third-party production partners. Estimated delivery dates are estimates rather than guarantees, subject to any rights that cannot lawfully be excluded.

INTELLECTUAL PROPERTY

The Milk Bar name, logo, artwork, photography, copy and website content are owned by or licensed to Milk Bar.

They may not be copied, reproduced, sold or used commercially without written permission, except where permitted by law.

CUSTOMER CONTENT

If you send or tag Milk Bar in a photograph, review or other content, you retain ownership of that content.

We will seek permission before using identifiable customer content in store marketing unless your submission clearly grants that permission.

You confirm that any content you authorise us to use is yours to share and does not infringe another person’s rights.

ACCEPTABLE USE

You must not misuse the store, interfere with its operation, attempt unauthorised access, introduce malicious code, scrape it unlawfully, commit fraud, or use its content in breach of another person’s rights or applicable law.

THIRD-PARTY SERVICES AND LINKS

The store relies on third parties including Shopify, payment providers, Gelato and delivery carriers. Third-party websites and services have their own terms and privacy practices.

We are not responsible for third-party content. However, this does not remove any responsibility that Milk Bar has under applicable law for products sold through the store.

AUSTRALIAN CONSUMER LAW AND LIABILITY

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these terms excludes, restricts or modifies a right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, Milk Bar is not liable for indirect or consequential loss that was not reasonably foreseeable. Any limitation applies only to the maximum extent allowed by law.

CHANGES AND GOVERNING LAW

We may update these terms prospectively by publishing a revised version. The terms applying to an order are those in effect when the order is placed.

These terms are governed by the laws of Victoria, Australia. The parties submit to the courts of Victoria and courts entitled to hear appeals from them.
